Draft, to be reviewed before launch

Terms of use

These terms cover your use of the On Chocks app and this website. By creating an account, you agree to them.

Last updated: [date]

Who we are

On Chocks is run by [full legal name], a sole trader in Australia (ABN [ABN]), [postal address]. In these terms "we" and "us" mean On Chocks, and "you" means you, the person using it.

Not affiliated with any airline

On Chocks is independent and not affiliated with any airline. No airline reviews, approves or endorses what crew post.

Who can use On Chocks

  • On Chocks is for pilots and cabin crew who work for an airline, aged 18 or over.
  • You verify with your airline work email and a 6-digit code. If that doesn't work, you can ask us to check you by hand with a "Can't verify?" request. Give us true details.
  • You get one account. Keep your account and codes to yourself, and tell us if you think someone else has used them.

Paying for On Chocks

On Chocks is free to download. After you verify, full access needs a purchase in the app. The app shows the price and what you get before you pay. Apple takes the payment and handles refunds under its own terms, and you can restore a purchase on a new phone from the app.

You pay once for each account. On Chocks has no subscription, and nothing renews.

We sometimes give free access, for example to crew who helped fill the first cities.

What you add

Before your first post, the app asks you to accept these rules. When you add a spot, quote, tip or photo:

  • Add only places you know first-hand and recommend.
  • Never add a crew hotel or any other place crew sleep, or anything that shows where crew stay.
  • Never name, describe or picture a person in a way that could identify them, including crew, staff and other guests.
  • Stick to facts and fair opinion. Criticise a place by saying what happened, not by attacking anyone.
  • Add only photos you took, of the venue, with no one identifiable in them.
  • No advertising, paid placements, or reviews and photos copied from elsewhere. If you own or work for a place, say so before you recommend it.
  • Nothing illegal, abusive, sexual, hateful or misleading.

You keep ownership of what you add. You give us a worldwide, royalty-free licence to store, show, resize and share it in the app, on share pages and on this website, for as long as we run On Chocks. The licence continues after you delete your account, for the posts you leave up. You confirm you have the right to give us that licence.

Using On Chocks fairly

Don't:

  • use On Chocks to find out where crew stay, or who a crew member is or which airline they fly for;
  • copy spots or quotes out of On Chocks in bulk, or use bots, scrapers or automated searches;
  • try to get around sign-in, limits, reports or blocks, or break into our systems;
  • harass other crew or the people who run the places you write about.

Reports and moderation

Anyone can report a spot, a quote or a photo, and block a crew member. When 2 crew report the same thing, the app hides it until we review it. We review reports and may edit or remove content, or suspend or close an account, that breaks these terms or the law. If we act on your account and you think we got it wrong, tell us through Complaints.

Crew opinions, not advice

Spots, hours, walk times, quotes and search results come from crew and from automated tools, and can be wrong or out of date. Check before you rely on anything, especially opening hours and safety.

On Chocks doesn't replace your airline's rules on layovers, rest, alcohol, safety or fitness for duty. You're responsible for following them.

Health & safety log

The health & safety log is a private record for you. It isn't a way to report an incident to your airline, a regulator or the police. Report safety incidents through your airline's official channels.

A health note on a spot counts log entries from verified crew at more than one airline. Nobody has checked the cause, and the note isn't a finding about the place.

Other services and links

On Chocks hands you to other services, such as Apple Maps and Google Maps for directions. Their own terms apply. Nobody can pay to list a spot, or to change which spots crew see or how they rank.

Our part

We own the On Chocks app, name, logo and design. You may use the app for your own layovers, and nothing else. We may change, add or remove features, and we try to tell you before a change that takes away something you paid for.

Liability

Nothing in these terms removes rights you have under the Australian Consumer Law or other laws that can't be excluded. Where the law lets us limit our liability for a failure to meet a consumer guarantee, we limit it to supplying the service again or paying the cost of having it supplied again.

Otherwise, as far as the law allows, we aren't liable for indirect or consequential loss, or for loss caused by what crew post or by places you visit. Our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Ending your account

You can delete your account in the app, from Me, at any time. We may suspend or close your account if you break these terms, or if we stop running On Chocks. If we stop running it, we'll give you at least 30 days' notice in the app.

Changes to these terms

When we change these terms, we update this page and the date at the top. If a change matters to how you use On Chocks, the app tells you before it applies. If you keep using On Chocks after that, the new terms apply.

Law

The laws of [Western Australia], Australia, govern these terms, and its courts can hear any dispute. You can also use the consumer protection laws and courts where you live, if they give you more rights.

App Store terms

If you got On Chocks from Apple's App Store, these points apply as well:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • You may use the app on Apple devices you own or control, as Apple's Usage Rules allow.
  • We, not Apple, provide support and maintenance for the app. Apple has no duty to support it.
  • If the app fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for the app. As far as the law allows, Apple has no other warranty duty for the app.
  • We, not Apple, handle any claim about the app, including product liability claims, claims that the app breaks a law or regulation, and consumer protection or privacy claims.
  • If someone claims that the app or your use of it infringes their intellectual property, we, not Apple, will investigate, defend and settle that claim.
  • You confirm that you aren't in a country under a United States government embargo or listed by it as a terrorist-supporting country, and that you aren't on any United States government list of prohibited or restricted parties.
  • You must follow the terms of any third-party service you use with the app, such as your mobile carrier.
  • Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.
